Welcome to Scrumarise, a product operated by PunkerDuck, a sole proprietorship registered in Türkiye.

These Terms of Use ("Terms") govern your access to and use of the Scrumarise website and services. By accessing or using Scrumarise, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the service.

2. Description of the Service

Scrumarise is an online Scrum Poker tool designed to help teams estimate tasks collaboratively.

We provide features that allow users to join sessions, participate in estimation rounds, and interact with other participants within the product environment.

Scrumarise does not provide AI-generated content, process audio recordings, or store user-generated documents beyond what is necessary for the real-time operation of the tool.

3. Accounts

To use Scrumarise, you must sign in using a Google account.

You agree to:

• Provide accurate information through your Google account
• Keep your login credentials secure
• Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use Scrumarise only for lawful and legitimate purposes. You must not:

• Use the service to harass, abuse, or harm other users
• Attempt to gain unauthorized access to systems or accounts
• Interfere with the operation, security, or performance of the service
• Use automated tools (bots, scripts) to misuse or overload the system
• Use the service in violation of applicable laws or regulations

5. Intellectual Property

All software, design, branding, and underlying technology of Scrumarise are the property of PunkerDuck and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms. You may not copy, reverse engineer, or resell the service or any part of it.

6. Third-Party Services

Scrumarise relies on third-party services, including:

• Google (for authentication and analytics)
• PostHog (for product analytics)

Your use of Scrumarise may also be subject to the terms and policies of these third parties.

7. Service Availability

We aim to keep Scrumarise available and functioning, but we do not guarantee uninterrupted or error-free service.

We may modify, suspend, or discontinue any part of the service at any time without liability.

8. Disclaimer of Warranties

Scrumarise is provided "as is" and "as available."

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, reliability, and non-infringement.

We do not guarantee that:

• The service will always be available
• The service will be free from errors or security issues
• Results or estimations made using the tool will be accurate or suitable for your needs

9. Limitation of Liability

To the fullest extent permitted by law, PunkerDuck and its operator shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, business, or data.

Since Scrumarise is currently provided free of charge, our total liability for any claim related to the service shall not exceed USD 100.

Some jurisdictions may not allow certain limitations, so parts of this section may not apply to you.

10. Termination

We may suspend or terminate your access to Scrumarise if you violate these Terms or use the service in a harmful or abusive way.

You may stop using the service at any time. Account deletion can be requested via email.

11. Changes to the Service or Terms

We may update the service or these Terms from time to time. Updated Terms will be posted with a revised Effective Date. Continued use of Scrumarise after changes means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles.
